Terms and Conditions
Scope of Services.
Garden Gems Landscaping (referred to as "the Company") offers professional landscaping services including design, installation, maintenance, and consultation. These services are provided based on the specific requirements outlined by the client and as agreed upon in writing between the client and the Company.
Service Agreement.
Before commencing any work, a formal service agreement outlining the scope of services, schedule, pricing, and payment terms will be provided to the client for review and approval. By engaging Garden Gems Landscaping services, the client agrees to abide by the terms and conditions outlined in this agreement.
Pricing and Payments.
The pricing for Garden Gems Landscaping services will be determined based on the scope of work and agreed upon in writing prior to commencement of the project. Payment terms, including deposit requirements, installment schedules, and accepted forms of payment, will be specified in the service agreement. Any additional costs incurred due to changes in project scope or unforeseen circumstances will be communicated to the client and agreed upon before implementation.
Project Timeline.
The timeline for completing landscaping projects will be provided to the client as part of the service agreement. While Garden Gems Landscaping strives to adhere to agreed-upon timelines, factors such as weather conditions, material availability, and unforeseen challenges may impact project completion dates. The Company will make every effort to communicate any delays or changes to the client in a timely manner.
Client Responsibilities.
The client agrees to provide Garden Gems Landscaping with access to the project site as needed for the duration of the project. Additionally, the client is responsible for obtaining any necessary permits or approvals required for the landscaping work. It is the client's responsibility to ensure that any utilities, irrigation systems, or other underground infrastructure on the property are clearly marked to avoid damage during construction.
Warranty and Guarantee.
Garden Gems Landscaping stands behind the quality of its workmanship and materials used in landscaping projects. The Company offers a warranty on installed plants and materials for a specified period, as outlined in the service agreement. Any issues or concerns regarding the landscaping work should be reported to Garden Gems Landscaping promptly, and the Company will take appropriate measures to address and rectify the situation within a reasonable timeframe.
Liability and Indemnification.
While Garden Gems Landscaping takes all necessary precautions to ensure the safety and integrity of its work, the Company shall not be held liable for any damages, injuries, or losses resulting from acts of nature, vandalism, negligence, or misuse of landscaping features by the client or third parties. The client agrees to indemnify and hold harmless Garden Gems Landscaping from any claims, liabilities, or expenses arising out of or related to the landscaping services provided.
Termination of Services.
Either party may terminate the landscaping services by providing written notice to the other party in accordance with the terms of the service agreement. In the event of termination, the client agrees to compensate Garden Gems Landscaping for any work completed up to the date of termination, as well as any applicable cancellation fees or costs incurred by the Company.
Governing Law.
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Garden Gems Landscaping operates. Any disputes arising out of or related to the landscaping services provided shall be resolved through amicable negotiations between the parties. If a resolution cannot be reached, the parties agree to submit to the exclusive jurisdiction of the courts in the relevant jurisdiction.
Amendments and Modifications.
Garden Gems Landscaping reserves the right to update or modify these terms and conditions at any time without prior notice. Any changes to the terms and conditions will be communicated to the client in writing and will apply to all future engagements with the Company.
By engaging Garden Gems Landscaping services, the client acknowledges that they have read, understood, and agree to abide by the terms and conditions outlined herein.
